2. WHAT INFORMATION DO WE COLLECT?

In Short: We collect personal information that you provide to us such as name, address, email, and contact information.

We collect personal information that you voluntarily provide to us when expressing an interest in obtaining information about us or our products and services or otherwise contacting us.

Publicly Available Personal Information. We collect first name, maiden name, last name, nickname, email addresses, and other similar data.

Online Identifiers. We collect cookie identifiers, or others such as the ones used for analytics and marketing, and other similar data.

3. FINANCIAL INFORMATION

We may collect data necessary to process cash back rewards, loyalty rewards, and brand ambassador payments, such as phone number related to Venmo account information and other financial information (“Financial Data”). Financial Data shall only be used as is necessary to issue cash back rewards and brand ambassador payments and comply with loyalty programs.

4. MOBILE TERMS AND CONDITIONS

By texting us with your receipt to opt into cash back rewards, or by opting into our loyalty rewards or brand ambassador payments or any of our services or to receive messages or offers from us, you consent to receive mobile text alerts using an automatic telephone dialing system and our PICADELI US MOBILE MESSAGING TERMS AND CONDITIONS.

5. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

To send you marketing and promotional communications. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. To enforce our terms, conditions and policies for Business Purposes, Legal Reasons and Contracts.

We may share your personal information with third parties that help us provide text-messaging services, including but not limited to platform providers, phone companies, and other vendors who assist us in the delivery of text messages.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of the Company to another company.
  • Third Party Advertisers. We may use third party advertising companies to serve ads when you visit the Services. These companies may use information about your visits to our Services and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.

  • Exclusions. All of the above categories of personal information exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

When you visit our Services, we may automatically collect certain information such as IP Addresses, browser types and versions, service providers, pages visited, unique device identifiers, operating systems, and more. This information does not reveal specific information about your identity, such as contact information, but may inform us about device and usage information that will help us maintain the security of our Services or for internal analytics and reporting. This information is solely collected to improve our Services and cater to your needs.  

Our Services use cookies and other tracking technology (such as web beacons and pixels) to track activity on our Services and retain certain information. Cookies are files that contain information to identify your devices that help customize and improve your web browsing experience. You have the option to refuse all cookies or change the settings on your browser to automatically refuse cookies. However, refusing cookies may impact the use and enjoyment of certain parts of our Services.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this Privacy Policy will require us keeping your personal information for longer than 2 years.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. In Short: You may review, change, or terminate your account at any time.

You may have certain rights in relation to your personal information including a right to access or to correct your personal information. These rights will only apply in certain circumstances. These rights will generally not be available if there are outstanding contracts between us, if certain laws or regulations require us to keep your personal information or if your personal information is relevant to a legal dispute. We’ve listed the rights you have over your personal information and how you can use them below.

  • You can remove consent, where you have provided it, at any time;
  • You can ask us to confirm if we are processing your personal information;
  • You can ask for access to your personal information;
  • You can ask to correct your personal information if it’s wrong;
  • You can ask us to delete your personal information;
  • You can ask us to restrict how we use your personal information;
  • You can ask us to help you move your personal information to other companies. To help with that, you have a right to ask that we provide your personal information in an easily readable format to another company;
  • You can ask us to stop using your personal information, but only in certain cases; and,

13. CONTROLS FOR DO-NOT-TRACK FEATURES

No uniform technology standard for recognizing and implementing DNT signals has been finalized. 14. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.   • Personal Information covered by sector-specific privacy laws, including but not limited to the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

We obtain the categories of Personal Information listed above from the following categories of sources:

  • Directly from consumers or their agents ;
  • Indirectly from consumers or their agents through the course of providing Services;
  • Directly and indirectly from activity on our Services including, but not limited to, submissions through our Services or Services usage details collected automatically; and,
  • From third parties that interact with us in connection with the Services.

Use of Personal Information

We may use or disclose the Personal Information we collect for one or more of the following business purposes:

  • To provide information, products or services;
  • To provide email alerts, event registrations and other notices concerning our products or services, or events or news;
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections;
  • To improve our Services;

When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information collected;
  • The categories of sources for the Personal Information collected;
  • Our business or commercial purpose for collecting that Personal Information;
  • The categories of third parties with whom we shared that Personal Information;
  • The specific pieces of Personal Information collected about you (a data portability request);
  • The right to correct inaccuracies in your Personal Information; and,
  • If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:some text
    • sales, identifying the Personal Information categories that each category of recipient purchased; and,
    • disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable request to delete, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the Personal Information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  3. Identify and repair errors that impair existing functionality;
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the Personal Information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent;
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  8. Comply with a legal obligation; or,
  9. Make other internal and lawful uses of that Personal Information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and,
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We can only respond to requests if we can verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, up to ninety (90) days, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. If applicable, the response we provide will explain the reasons we cannot comply with a request. For data portability requests, we will select a format to provide your Personal Information that is readily useable and allows you to transmit the Personal Information from one entity to another entity.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or,
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
